PUBLISHING RIGHTS
Upon sending the final version of the cover design, Alie Nolan Designs grants the client exclusive license to use the final version of the cover design.
Alie Nolan Designs will provide .jpg files for ebook covers, and .jpg and .pdf files for paperback cover. No .psd or other source files will be provided.
The client agrees that they have no rights to alter the final designs in any way with the exception of resizing for production and display.
If the client needs other sizes of a cover in the same ratio, those will also be provided upon request. If the client needs the sizing changed to a different ratio (i.e. changing 6x9" to 5.5x8") this will need to be stated in the client's initial discussion/agreement with Alie Nolan Designs, before final files are released to the client. Any changes to ratio needed after the final files are released will carry an additional cost.
The client may not alter the completed design in any way, or have another person/designer alter any of the provided work/graphics/cover art in any way.

OWNERSHIP RIGHTS
Upon receipt of full payment, Alie Nolan Designs grants the client exclusive license to use the final cover design artwork (JPG, PDF, or any other provided format) for her/his/their book cover and associated promotional materials.
The client understands that they have no right to alter the final cover design in any way except to change the size for printing or digital display. If the client desires any alterations, they will consult Alie Nolan Designs. The client understands that additional payments may be required to make these alterations.
Final rights of the working/editable file(s) are still solely owned by Alie Nolan Designs and cannot be licensed, sold, or given to any third parties.
Alie Nolan Designs retains the right to use the final book cover design for Alie Nolan Designs marketing and promotional purposes. Copyright and ownership of all draft design materials belong to Alie Nolan Designs.

CONFIDENTIALITY
Client information is confidential. Any information provided to Alie Nolan Designs will be considered confidential and will only be used for the purpose of quoting and completing the service the client has ordered. Alie Nolan Designs will not share confidential information or assets with third parties except as requested by the client.

IMAGE USAGE
The client agrees to abide by the terms and conditions of third-party image resource license agreements for images purchased by Alie Nolan Designs. The client is limited to a 500,000 copy print run using each premade cover, and an unlimited run of ebook copies. If the client exceeds 500,000 units in sales, an extended license may be required. It is the responsibility of the client to notify Alie Nolan Designs if they require an extended license. Client assumes responsibility for any fees associated with extended licenses.

CLIENT RESPONSIBILITIES
The client is responsible for providing Alie Nolan Designs with the correct information regarding cover text spelling, book cover size, and page count (spine size).
Alie Nolan Designs will not be held financially or legally responsible for expenses or problems related to use of the cover design.

PAYMENT
All payments with be issued via a PayPal invoice after an initial email discussion between Alie Nolan Designs and the client. Alie Nolan Designs will not release final files to the client or third parties until the final balance has been paid in full. Once the final files have been released to the client, this contract will be considered fulfilled

ATTRIBUTION
Alie Nolan Designs requires credit to appear in client’s book in front matter or back matter.

LIABILITY
Alie Nolan Designs is not liable for incidental, punitive, indirect, consequential, or exemplary damages of any kind. This includes loss of projects/revenues, loss of business/reputation, or loss of data. Alie Nolan Designs is not responsible for any claim, loss, or injury based on errors or any other inaccuracies in clients documents, written work, or on Alie Nolan Designs’ website, including without limitation as a result of any breach of the terms and conditions of the agreement.
Any claim against Alie Nolan Designs shall be limited to the relevant fee(s) paid by the customer/client.

REFUNDS
All premade book cover designs are final. No refunds will be issued.

RESALE
All book cover designs, and any of the elements that make up a book cover design, may not be resold by an author or any third parties.

AGREEMENT
Agreement constitutes the entire agreement between all parties concerning the subject matter hereof. There are no warranties, representations, covenants or agreements, expressed or implied, between the parties except those expressly set forth in this agreement. Any amendments or modifications of this agreement shall be in writing and executed by the contracting parties.
Client agrees that this agreement of terms and conditions may not be altered in any way. Any alternations are invalid.

COMPANY RIGHTS
The current Terms and Conditions listed on Alie Nolan’s website supersede any previous Terms and Conditions distributed in any form. We also reserve the right to change any rates and any of the Terms and Conditions at any time without prior notice. Alie Nolan Designs can refuse to work with any client, refuse any project at any time, and/or terminate a project and refund any payments made to date, if we see fit.
